A lawyer for two photography professionals said seven nude and semi-nude Marilyn Monroe photos that are the subject of a lawsuit in New York were found in kerbside rubbish nearly 35 years ago.
The photos were shot by Bert Stern at the Bel Air Hotel in Los Angeles in 1962 while he was on assignment for Vogue magazine.
Mr Stern claimed in a lawsuit filed last week that some of the film was stolen.
Lawyer Jamie Brickell said retoucher Michael Weiss and printer Don Penny did nothing wrong to get the film and never asked Mr Stern for money as he claimed.
He said they only asked for print copies from the film.
Mr Stern's lawyer said he would respond to Mr Brickell later.
